Algemene Verkoopvoorwaarden – CS Jewels

1. Definities:

·        Ondernemer: CS Jewels, gevestigd in Nederland.

·        Klant: iedere natuurlijke of rechtspersoon die een product bestelt via de webshop.

·        Producten: handgemaakte sieraden, memorial‑producten, gepersonaliseerde items en aanverwante accessoires.

·        Overeenkomst: iedere bestelling en aankoop via de webshop.

2. Toepasselijkheid:

Deze voorwaarden zijn van toepassing op alle aanbiedingen, bestellingen, overeenkomsten en leveringen via Madebycis.com. Afwijkingen zijn alleen geldig wanneer schriftelijk bevestigd door CS Jewels.

3. Aanbod en prijzen:

Alle prijzen zijn inclusief btw. Afbeeldingen, kleuren en product weergaven zijn indicatief. Kennelijke fouten of vergissingen in het aanbod binden de ondernemer niet.

4. Handgemaakte producten & afwijkingen:

Alle producten van CS Jewels worden met de hand vervaardigd. Hierdoor kunnen kleur, vorm, structuur, glans en afwerking licht afwijken van de foto’s op de website. Deze variaties zijn inherent aan het ambachtelijke karakter van het product en vormen geen gebrek, geen non‑conformiteit en geen grond voor retour, vervanging of schadevergoeding. Klant erkent dat handgemaakte producten nooit 100% identiek zijn aan voorbeeldfoto’s.

5. Gepersonaliseerde producten:

Gepersonaliseerde of op maat gemaakte producten (zoals initialen, gravures, vingerafdrukken, as‑verwerking) zijn uitgesloten van herroepingsrecht (art. 6:230p BW). De klant is verantwoordelijk voor het correct aanleveren van gegevens, maten, teksten en materialen. CS Jewels is niet aansprakelijk voor schade of verlies van aangeleverd materiaal, tenzij sprake is van opzet of grove nalatigheid.

6. Levering:

Levertermijnen zijn indicatief en geen fatale termijnen. Vertraagde levering geeft geen recht op schadevergoeding. Risico van verlies of beschadiging gaat over op de klant zodra het pakket is overgedragen aan de vervoerder.

7. Retourbeleid:

De klant heeft het recht de bestelling binnen 14 dagen na ontvangst te retourneren, zonder opgave van reden (Wet koop op afstand). Handgemaakte producten kunnen licht afwijken van foto’s; dit is onderdeel van het ambachtelijke karakter en vormt geen reden voor retour of klacht, tenzij aantoonbaar defect. Het product moet ongedragen, onbeschadigd en in originele verpakking worden geretourneerd. Gepersonaliseerde of op maat gemaakte producten zijn uitgesloten van retour. Retourkosten zijn voor rekening van de klant, tenzij het product aantoonbaar defect is. Na ontvangst en inspectie wordt het aankoopbedrag binnen 14 dagen teruggestort.

8. Garantie:

Garantie wordt verleend conform de wettelijke regels. Garantie vervalt bij verkeerd gebruik, contact met chemicaliën, onjuist onderhoud of normale slijtage. CS Jewels is niet aansprakelijk voor indirecte schade, gevolgschade of emotionele schade.

9. Aansprakelijkheid:

CS Jewels sluit, voor zover wettelijk toegestaan, de volgende aansprakelijkheden uit:

·        indirecte schade, gevolgschade, winstderving of emotionele schade

·        schade door verkeerd gebruik

·        schade door onjuiste aanlevering van gegevens of materialen

·        schade door kleur‑, maat‑ of materiaalafwijkingen binnen redelijke tolerantie

·        schade door vertragingen in levering

·        schade tijdens transport

CS Jewels is uitsluitend aansprakelijk voor directe schade veroorzaakt door opzet of grove nalatigheid.

10. Betaling:

Betaling gebeurt via de aangeboden betaalmethoden (iDEAL, creditcard, Wero, etc.). Bij mislukte betaling wordt de bestelling niet verwerkt.

11. Overmacht:

Bij overmacht (zoals storingen, ziekte, vervoersproblemen, materiaaltekorten) heeft CS Jewels het recht de overeenkomst op te schorten of te ontbinden zonder schadevergoeding.

12. Intellectuele eigendom:

Alle ontwerpen, foto’s, teksten en product concepten zijn eigendom van CS Jewels. Kopiëren, verspreiden of namaken is verboden.

13. Klachten:

Klachten kunnen worden ingediend via: info@madebycis.com Reactie binnen 14 dagen.

14. Toepasselijk recht:

Op alle overeenkomsten is Nederlands recht van toepassing. Geschillen worden voorgelegd aan de bevoegde rechter in Nederland.

15. Slotbepalingen:

Indien een bepaling ongeldig is, blijven de overige bepalingen volledig van kracht. CS Jewels mag de voorwaarden wijzigen; de nieuwste versie geldt voor nieuwe bestellingen.

 

Terms and Conditions – CS Jewels (English Version)

1. Definitions

·        Entrepreneur: CS Jewels, based in the Netherlands.

·        Customer: any natural or legal person who places an order through the webshop.

·        Products: handmade jewelry, memorial products, personalized items, and related accessories.

·        Agreement: any order and purchase made through the webshop.

2. Applicability:

These terms and conditions apply to all offers, orders, agreements, and deliveries made through Madebycis.com. Deviations are only valid if confirmed in writing by CS Jewels.

3. Offer and Prices:

All prices include VAT. Images, colours, and product representations are indicative. Obvious errors or mistakes in the offer do not bind the entrepreneur.

4. Handmade Products & Variations:

All CS Jewels products are handmade. As a result, colour, shape, texture, shine, and finish may differ slightly from the photos on the website. These variations are inherent to the artisanal nature of the product and do not constitute a defect, non‑conformity, or grounds for return, replacement, or compensation. The customer acknowledges that handmade products can never be 100% identical to example photos.

5. Personalized Products:

Personalized or custom‑made products (such as initials, engravings, fingerprints, ash integration) are excluded from the right of withdrawal (Article 6:230p Dutch Civil Code). The customer is responsible for providing correct information, sizes, texts, and materials. CS Jewels is not liable for damage or loss of supplied materials unless caused by intent or gross negligence.

6. Delivery:

Delivery times are indicative and not strict deadlines. Delayed delivery does not entitle the customer to compensation. The risk of loss or damage transfers to the customer once the package has been handed over to the carrier.

7. Return Policy:

The customer has the right to return the order within 14 days of receipt, without giving any reason (Dutch Distance Selling Act). Handmade products may differ slightly from photos; this is part of the artisanal nature and does not constitute grounds for return or complaint, unless the product is demonstrably defective. Returned products must be unworn, undamaged, and in their original packaging. Personalized or custom‑made products are excluded from returns. Return shipping costs are borne by the customer unless the product is demonstrably defective. After receipt and inspection, the purchase amount will be refunded within 14 days.

8. Warranty:

Warranty is provided in accordance with statutory regulations. Warranty does not apply in cases of misuse, contact with chemicals, improper maintenance, or normal wear and tear. CS Jewels is not liable for indirect damage, consequential damage, or emotional damage.

9. Liability:

CS Jewels excludes, as far as legally permitted, liability for:

·        indirect damage, consequential damage, loss of profit, or emotional damage

·        damage caused by misuse

·        damage resulting from incorrect information or materials provided by the customer

·        colour, size, or material variations within reasonable tolerance

·        delays in delivery

·        damage occurring during transport

CS Jewels is only liable for direct damage caused by intent or gross negligence.

10. Payment:

Payment is made through the offered payment methods (iDEAL, credit card, Wero, etc.). If payment fails, the order will not be processed.

11. Force Majeure:

In cases of force majeure (such as disruptions, illness, transport issues, material shortages), CS Jewels has the right to suspend or terminate the agreement without compensation.

12. Intellectual Property:

All designs, photos, texts, and product concepts are the property of CS Jewels. Copying, distributing, or reproducing them is prohibited.

13. Complaints:

Complaints can be submitted via: info@madebycis.com, CS Jewels will respond within 14 days.

14. Applicable Law:

All agreements are governed by Dutch law. Disputes will be submitted to the competent court in the Netherlands.

15. Final Provisions:

If any provision is invalid, the remaining provisions remain fully in force. CS Jewels may amend these terms; the latest version applies to new orders.
